Welcome to Green Server . These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your use of our web hosting services (“Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

#0. KYC Enforcement Policy

We use Digio (digio.in) as our third-party provider to verify your identity (KYC). By proceeding, you consent to sharing your details with Digio solely for verification.

• 0.1. Scope & Requirement
  • KYC (Know Your Customer) is mandatory for all customers (individuals and businesses) who purchase or use any Green Server  service.
  • We accept Aadhaar as the only KYC document, and no other verification option is available. Please ensure your Aadhaar details are submitted to complete the process.
  • Customers may complete checkout without KYC, but KYC verification must be completed within 24 hours from the time of order.
  • Until KYC is verified, services remain in a Provisioned – Pending KYC state and are subject to suspension as described below.
• 0.2. How to Complete KYC
  • KYC must be submitted via the Client Area KYC page and completed using our supported verification flow.
  • We may request government-issued ID, selfie/live verification, and proof of address. For business accounts, we may request business registration documents and an authorized signatory ID.
  • All information must be accurate, current, and match the account holder (or authorized business representative).
• 0.3. Deadline & Enforcement
  • If KYC is not completed and approved within 24 hours of order, the service will be automatically suspended until verification is completed.
  • Suspended services do not accrue SLA credits and may be terminated pursuant to our Cancellation Policy if KYC remains incomplete for an extended period at our discretion.
  • We may send reminder notifications before suspension; however, reminders are a courtesy and not a condition to suspend.
• 0.4. Approval & Activation
  • After successful KYC verification, the customer must open a support ticket requesting activation.
  • Our team will review the account and manually activate eligible services during support hours (see #19. Support Policy).
• 0.5. Refund Eligibility Tied to KYC
  • Refunds are only available to customers with completed and approved KYC.
  • If KYC is incomplete, rejected, or not provided, the customer is not eligible for a refund.
  • All other refund conditions are governed by our Refund Policy. Chargebacks or payment disputes initiated without completing KYC may be treated as abuse.
• 0.6. Rejections, Mismatch & Re-verification
  • We may reject KYC due to document forgery, tampering, mismatch with account details, or inability to verify identity/address.
  • We may request additional documents or re-verification at any time (e.g., material account changes, regulatory needs, suspected fraud).
  • Submission of false or misleading information may result in immediate suspension or termination without refund and may be reported to authorities.
• 0.7. Business/Reseller Accounts
  • Business customers must provide entity details and authorized signatory verification. We may require documentation for ultimate beneficial ownership and business address.
  • Resellers must ensure their end-customers comply with applicable KYC/AML regulations where required.
• 0.8. Privacy & Data Handling
  • KYC data is collected and processed for identity verification, fraud prevention, legal compliance, and service eligibility assessment.
  • Data is handled in accordance with our Privacy Policy and may be shared with trusted verification providers solely for the purposes stated.
  • Retention is for a period reasonably necessary to meet legal, regulatory, and operational requirements.
• 0.9. Sanctions & Prohibited Use
  • We may decline or terminate service where KYC cannot be completed due to sanctions, regulatory restrictions, or risk concerns, consistent with #20. Prohibited Countries / OFAC Compliance and our AUP.
• 0.10. Changes to KYC Requirements
  • We may update KYC requirements at any time to reflect legal, regulatory, or risk management changes. Continued use of services constitutes acceptance of the updated requirements.

#1. Abuse Policy

We strictly prohibit any websites or content that promotes illegal activities or presents content that may damage our servers or any other servers on the . Linking to such materials is also strictly prohibited. Any attempt to undermine or cause harm to our servers is strictly forbidden, and detection of such activities may result in service suspension without prior notice. We hold the authority to suspend your account without refund if we detect any malicious activities. Server abuse includes, but is not limited to, the following:

• • 1.1. CPU/Resource intensive programs
  • 1.2. Denial of Service (DoS) Attacks
  • 1.3. Hacking/cracking of any kind (including exploits)
  • 1.4. Account trading
  • 1.5. Spamming
  • 1.6. Transmission, storage, or distribution of any information, data, or material in violation of any law or regulation, including copyrighted material, trademarks, or any other illegal content. Examples include, but are not limited to, movies, MP3s, pirated software, hacker programs, or warez sites.
  • 1.7. IRC on our VPS and shared servers
  • 1.8. Warez, image/file dump, mirror, or ad services
  • 1.9. Sale of controlled substances or online pharmacies
  • 1.10. Autosurf sites, investment sites, escrow, HYIP, bank debenture programs, or lottery sites
  • 1.11. Brute force programs, IP scanners, mail bombers, and spam scripts
    
    
  • 1.12. Phishing
  • 1.14. We do allow game servers on our VPS accounts, provided they follow our server resource policy. Personal proxies are allowed.

If we determine that you have engaged in any of the above activities, or any other activities that we deem harmful or abusive, we reserve the right to take immediate action, which may include:

• • Suspension or termination of your account.
  • Removal of any content that violates our policies.
  • Reporting your activities to the appropriate authorities.

Any violation of this policy may result in immediate suspension or termination of the service without refund. Green Server reserves the right to report such activities to law enforcement.

#2. Domain Registration

• 2.1. Eligibility:
  • You must be at least 18 years old or the legal age of majority in your jurisdiction to register a domain.
  • Accurate and complete registration information must be provided at the time of registration.
• 2.2. Domain Registration Process:
  • Domain registration is subject to availability and approval by the domain registry.
  • The registration is not guaranteed until confirmed by the domain registry.
• 2.3. Accuracy of Information:
  • You are responsible for ensuring that all WHOIS information is accurate and up-to-date.
  • False or incomplete information may result in the suspension or cancellation of the domain.
• 2.4. Fees and Payment:
  • All fees for domain registration, renewal, or related services must be paid in full before the domain is activated.
  • Domain registration fees are non-refundable once the registration process is completed.
• 2.5. Renewals and Expiration:
  • It is your responsibility to renew your domain before its expiration date. Failure to do so may result in the loss of the domain.
  • We are not liable for any consequences arising from the failure to renew your domain.
• 2.6. Domain Ownership and Use:
  • The registered domain owner is solely responsible for its use and compliance with applicable laws.
  • Domains may not be used for illegal activities, spamming, or distributing harmful content.
• 2.7. Suspension and Termination:
  • Your domain may be suspended or terminated for non-compliance with these terms, non-payment of fees, or as directed by the domain registry or law enforcement.
• 2.8. Dispute Resolution:
  • Domain disputes are subject to the Uniform Domain-Name Dispute-Resolution Policy (UDRP) or any other applicable policies enforced by the domain registry.
• 2.9. Limitation of Liability:
  • We are not responsible for any losses resulting from the suspension, termination, or non-registration of a domain.
  • Our total liability is limited to the amount paid for the domain registration service.
• 2.10. Modifications:
  • We reserve the right to modify these domain registration terms at any time, with changes taking effect immediately upon being posted on our website.
• 2.11. Compliance with Registry Policies:
  • All domain registrations are subject to the terms and conditions of the relevant domain registry.
• 2.12. Domain Hijacking:
  • Responsibility Disclaimer:

– We are not responsible for any domain hijacking or unauthorized access. This includes financial losses, data losses, or operational disruptions.

• • Theft Protection Requirement:

– You must purchase and maintain theft protection services to secure your domain. Details and costs will be provided at registration or renewal.

• • Customer Responsibility:

– You are responsible for the security of your domain credentials and must report any suspicious activity or security breaches promptly.

• • Limitation of Liability:

– We are not liable for any damages resulting from domain hijacking. Our liability is limited to the amount paid for theft protection services during the affected period.

#3. Cancellation Policy

• 3.1. Right to Cancel:

– Green Server reserves the right to cancel any service at any time under certain circumstances. If the suspension or cancellation of services is due to a policy violation, you are not eligible for a refund under any circumstances.

• 3.2. Customer-Initiated Cancellation:

– Customers can cancel any service at any time. However, no refund will be provided if the cancellation is requested after 24 Hours of purchase (only for Managed Web/Shared Hosting). No refunds will be provided for VPS and dedicated or custom plans.

• 3.3. Unintentional Recurring Payments:

– If you cancel your account and your payments continue to recur for any reason, such as:
– By mistake of Green Server staff.
– By an error of the credit card processor.
– By an error of any other payment collection company.
– Green Server is to be held free of liability for any overdraft fees that are issued by your financial institution. All the licenses provided with services and add-ons are non-refundable.

#4. Storage Policy

• 4.1. You cannot host video or music sites. Our hosting services are optimized for websites that do not require extensive bandwidth for streaming or downloading multimedia content. Hosting video or music files can negatively impact server performance and is not permitted.
• 4.2. You cannot use our web hosting for storage. Our services are designed for hosting websites, not as a general storage solution. Storing large amounts of non-website related data is prohibited.
• 4.3. You cannot use our web hosting for backing up your files. Our hosting solutions are not intended for data backup purposes. Please use dedicated backup services to secure your data.
• 4.4. You cannot upload multiple large files. To maintain optimal server performance and fair use among all customers, the upload of numerous large files is restricted. Please ensure your uploads are necessary and relevant to your website.
• 4.5. Every email account has a maximum storage size of 512MB. This limit helps ensure that email services remain efficient and reliable. Please regularly manage your email storage to avoid disruptions.

#5. Content Policy

• 5.1. Hosting content that promotes any adult content, video sites, music sites, or any racist content (including but not limited to color, religion, creed, or any beliefs) will result in immediate suspension of services.
• 5.2. You can’t use web hosting as a file hosting service to store your files.
• 5.3. Cron jobs are allowed at a minimum interval of 15 minutes. If you use it for less than 15 minutes, we reserve the right to suspend your hosting account.
• 5.4. Green Server provides hosting infrastructure only and is not responsible for the legality, security, or accuracy of client-hosted content.
• 5.5. The client is solely responsible for ensuring that their website content complies with all local, national, and international laws, including copyright and intellectual property regulations.
• 5.6. Green Server reserves the right to remove any content that violates its policies or applicable laws without notice.
• 5.7. Green Server is not liable for any legal consequences arising from client content.

#6. Uptime Guarantee

Green Server  strives to provide a reliable and high-quality web hosting service. However, there are certain situations where service interruptions or downtime may occur. These situations are outlined below:

• 6.1. Scheduled Maintenance

Any service interruptions or downtime due to scheduled maintenance by Green Server  or our network providers will not count towards the uptime guarantee. We will make every effort to notify customers in advance of any scheduled maintenance that may affect the availability of our services.

• 6.2. Third-Party Service Failures

Green Server  is not liable in any way for failures of third-party services. This includes, but is not limited to, issues such as:

• • Apache server downtime
  • LiteSpeed server downtime
  • Failures of any other third-party software or services used in conjunction with our hosting services
• 6.3. Force Majeure

Green Server  will not be liable for any failure or delay in performing its obligations if such failure or delay is due to circumstances beyond our reasonable control. These circumstances include, but are not limited to:

• • Acts of any governmental body
  • War, insurrection, sabotage, or embargo
  • Fire, flood, or other natural disasters
  • Strikes or other labor disturbances
  • Interruptions or delays in transportation
  • Unavailability or interruptions in telecommunications or third-party services (including DNS propagation)
  • Failure of third-party software or hardware
  • Inability to obtain raw materials, supplies, or power necessary for the provision of our services

In such events, Green Server  will make reasonable efforts to mitigate the effects of the force majeure event and resume services as soon as possible.

#7. Adult Content

Our web hosting service strictly prohibits the hosting or distribution of adult content, including but not limited to, pornography, sexually explicit material, and any content deemed inappropriate for minors. If you are found to be hosting or distributing adult content on your website, your service will be terminated immediately without any notice.

We reserve the right to determine what constitutes adult content and to enforce this policy at our discretion. If you have any questions regarding this policy, please contact our support team for clarification.

#8. Backups and Data Policy

We do not provide data backups for your account. It is your responsibility to maintain regular backups of your website data and content. We are not liable for any data loss or damage, including but not limited to data corruption, accidental deletion, or hardware failure.

We strongly advise all our clients to implement their own backup solutions to ensure the safety of their data. While we employ various security measures to protect your data, it is essential to take additional precautions to safeguard your information. By using our services, you agree to take full responsibility for your data backups and acknowledge that we shall not be held accountable for any data loss or related consequences.

#9. Copyrighted Content

We are committed to respecting and protecting the intellectual property rights of others. By using our services, you agree to the following terms regarding copyrighted content:

• • 9.1. You must ensure that any content you upload, store, or distribute through our services does not violate any copyright laws. This includes, but is not limited to, text, images, videos, music, software, and any other type of media or intellectual property.

• • 9.2. If you do not have the necessary rights or permissions to use copyrighted content, you are prohibited from uploading, storing, or distributing it through our services.

• • 9.3. We reserve the right to immediately terminate your account and access to our services if we determine, at our sole discretion, that you have infringed upon the intellectual property rights of others. This termination will occur without prior notice.

• • 9.4. In addition to termination of services, we may also remove or disable access to any infringing content, and we may report the infringement to the relevant authorities or parties.

• • 9.5. You agree to indemnify and hold us harmless from any claims, damages, or expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these terms regarding copyrighted content.

We take copyright infringement seriously and strive to ensure that our platform remains a safe and lawful environment for all users. If you upload or use any copyrighted content without proper authorization, your service will be terminated immediately without any notice.

#10. Spam / Mail Policy

We do not allow spam or bulk emailing under any circumstances. You cannot use our servers or services for bulk or unsolicited emails. You can send up to 100 messages per hour with your account. Subscribing email addresses to any mailing list without the express permission of the email address owner is prohibited. All mailing lists run on our servers must be Closed-loop (Confirmed Opt-in). Users may be charged a fee of ₹30,000 or more for blacklist removal.

#11. Use of the services / content

• 11.1. The Customer is obligated to check and comply with the legal provisions arising from the use of the contractually agreed services, in particular the Telecommunications Act, the Telemedia Act, as well as national and international industrial and intellectual property rights, personal rights, and the requirements of competition and data protection laws on their own. The Customer indemnifies us against all claims of third parties arising from infringements of these obligations.
• 11.2. The Customer is obligated not to publish any content that infringes on the rights of third parties or otherwise violates applicable law. This includes in particular, but is not limited to, pornographic or obscene material, extremist content or content that offends common decency, gambling, material that could seriously endanger the morals of children or young people or violate the rights of third parties (copyrights, name rights, trademark rights and data protection rights). This also includes the publication of defamatory content, insults or disparagement of persons or groups of persons.
• 11.3. The transmission of spam mail is prohibited. This includes in particular the sending of unauthorized, unsolicited advertising to third parties. When sending emails, it is also prohibited to provide false sender data or to disguise the identity of the sender in any other way. The operation of applications for mining cryptocurrencies remains prohibited. These include, but are not limited to, mining, farming and plotting of cryptocurrencies. We are entitled to lock the Customer’s access to their Green Server services or account in the event of non-compliance.
• 11.4. If we become aware of illegal activities, we are obligated under Art. 6 Abs. 1 DSA (Digital Services Act) to request that the Customer immediately removes the offending content and we are entitled to lock the Customer’s access to their Green Server services or account.

#12. Resources
